Candidate Terms of Service
Last updated: 19/08/2026 · v2.0
These Candidate Terms of Service (the “Terms”) govern the use of the JOBO Platform by individuals who create a personal account to take part in selection processes (the “Candidate”, “you”).
The Platform is operated by JOBO PEOPLE TECHNOLOGIES, S.L., Sociedad Unipersonal (sole-shareholder company), tax ID B88736665, with registered address at Calle Barrau 1, Bloque H, Portal 6, 1.º A, 41018 Seville, Spain. You can contact us at hola@joboapp.es.
Companies that contract the Service are governed by the Business Terms of Service (B2B), which are a separate contract.
1. Purpose and applicable documents
1.1. These Terms govern your access to and use of the Platform as a Candidate: creating an account, applying to selection processes, taking the tests and interviews each company has enabled, and checking the status of your applications.
1.2. Alongside these Terms, the Privacy Policy, the information on Automated Decisions and AI Transparency, the Cookies Policy and the Accessibility Statement apply.
1.3. Order of precedence. If anything in these Terms contradicts one of those documents, the specific document prevails on the matter it governs: the Privacy Policy on the processing of personal data, and the Automated Decisions information on how AI evaluation works. In everything else, these Terms prevail.
2. How you accept and what is recorded
2.1. To use the Platform you must accept these Terms by ticking the relevant box when you register. The boxes are not pre-ticked and each document is accepted separately.
2.2. When you accept, we store a receipt recording which document you accepted, in which version, a technical fingerprint of the exact text shown to you, and the date and time. That receipt is the evidence of what you signed, and it is never modified.
2.3. You may request your acceptance history at any time by writing to legal@joboapp.es, and we will provide it on a durable medium you can keep.
2.4. The contract is concluded in the language you are browsing in when you accept it. Before accepting you can read the full text on this page and, if you spot an error in the data you entered, correct it on the registration screen itself.
3. Who can register and what data is required
3.1. Age. You must be at least 18 years old. By registering you expressly declare that you are. If we detect an account belonging to a minor, we will delete it.
3.2. Accurate data and data required for the tests. The information you provide (name, email, CV, answers) must be truthful, accurate and up to date. To start any test your personal profile must be complete: full name, date of birth, phone number and identity document. While any of that is missing, the Platform will not let you start a test.
3.3. One application per person and process. You may submit only one application per selection process. The check is made against your identity document: if that document has already been used to apply for that same position, the Platform will not accept a second application, even from another account.
3.4. Your account is yours. You are responsible for keeping your credentials confidential and for all activity carried out from your account. Tell us immediately at hola@joboapp.es if you detect unauthorised access.
4. Your content
4.1. It remains yours. You retain ownership of everything you provide: CV, answers, video and audio.
4.2. What you authorise us to do with it. You grant us a worldwide, non-exclusive, royalty-free, non-transferable and non-sublicensable licence, strictly limited to operating the Service: storing your content, processing it, showing it to the companies whose processes you apply to, and analysing it through the AI systems described in Automated Decisions. This licence terminates automatically when you delete your account or when the content is deleted under clause 9. We do not use your content for advertising, we do not transfer it to third parties outside the process, and we do not train AI models with it.
4.3. What you warrant. That your content is yours or you are entitled to provide it, that it does not infringe third-party rights and that it is neither unlawful nor discriminatory.
5. How the tests work
5.1. Which tests exist. Depending on what each company enables, a process may include: a cognitive test, a team-roles questionnaire (TRCE), a situational judgement test (SJT), the City Survival exercise, a technical test, a video interview and an English level test. Before starting each one you will see a screen explaining what it measures, how long it takes and how it is assessed. You can take them in any order and on different days: your progress between tests is saved.
5.2. One attempt per test and process. Each test may be taken only once in each selection process. The attempt is used up when you start it, not when you submit it, and the exact moment depends on the test:
- Technical test, SJT, cognitive test and English level: the attempt is used up when you press “Start”, after reading the instructions and accepting the integrity notice.
- Team-roles questionnaire (TRCE), video interview and City Survival: the attempt is used up when you open the test, before the instructions screen.
Do not open a test until you have the time and quiet to complete it in one go.
5.3. Time. Each test has a time limit that is shown to you before you start. The clock is set and enforced by our server from the moment you start the test; the counter you see on screen is informational. The team-roles questionnaire has no time limit. In the video interview, what is limited is the recording length. We send no reminder before the time runs out: if you leave a test open, the clock keeps running.
5.4. What happens if you interrupt it. If you close the tab, lose your connection, abandon the test or run out of time, the test is treated as taken and is closed. The result depends on the test:
- In the technical test, the SJT and City Survival, which save your progress automatically, you are assessed on whatever you had answered up to that point. In the technical test, unanswered questions do not count against you.
- In the cognitive test, the team-roles questionnaire and the video interview, which do not save partial progress, the test is left with no result. This matters: in these three, interrupting does not produce a low score, it produces the absence of a score, with the effect described in clause 5.5.
5.5. What effect a test with no result has. A test that the company enabled and that you do not complete counts as zero in your final score, and its weight is not redistributed among the other tests. In other words: it does not disappear from the calculation, it counts as zero. In addition, if the process has mandatory requirements and your application does not meet them, your final score in that process will be zero regardless of your results. You can see the details of the calculation in Automated Decisions.
5.6. When the attempt is NOT counted. If you open a test and do not answer anything at all —because it did not load, because you opened the wrong link or because you left immediately— the system does not count the attempt and you may start it again with the full time. The rule is simple: if no answer of yours was recorded, you have not used up the attempt.
5.7. Technical incidents and second chances. If a technical problem prevents you from taking a test properly, write to hola@joboapp.es describing what happened. We will review the technical log of your session and, where appropriate, reopen the test: the previous attempt and its result are deleted, your application returns to the pending-tests state and we notify you so you can retake it. Every reopening is recorded with its reason. The decision to reopen is ours, and we take it on the basis that no candidate should lose an opportunity because of a failure that is not theirs.
5.8. Results reused for 90 days. The results of the cognitive test, TRCE, City Survival and English level are kept for 90 days and are copied automatically, without you having to ask, to new processes you apply to during that period. While a result remains valid you cannot retake that test at will. You will have to take it again if the process uses a different version of the test, if you had already taken it for that position, or if the stored result cannot be validated. A result obtained after an interruption is also stored and reused like any other. When the 90 days end, the result is deleted.
6. Adjustments and accessibility
6.1. If you need an adjustment in order to take the tests because of a disability, neurodivergence, illness or any other circumstance affecting how you respond —for example more time, screen-reader compatibility, contrast or font adjustments, additional breaks or an alternative format— you may request one.
6.2. How to request it. Contact the company that opened the process, which decides what adjustment is reasonable because that is its legal obligation. You can also tell us at hola@joboapp.es: we will tell you which adjustments are technically possible on the Platform and will apply them once the company confirms.
6.3. When to request it. Request it before starting the tests whenever you can. But if you did not do so in time and you need it, tell us anyway — the possible adjustments include reopening a test you have already started, so you do not lose your opportunity for not having known earlier.
6.4. We treat this information confidentially. It is not part of your evaluation, it is not shared with the company beyond what is needed to apply the adjustment, and it does not deduct points.
6.5. Our accessibility commitment and the content that is not yet fully accessible are set out in the Accessibility Statement. We undertake to respond to any accessibility-related request within a maximum of 20 working days.
7. Test integrity
7.1. Your commitment. You undertake to take the tests and interviews personally and without outside help. It is prohibited to: have another person take them for you or assist you; use artificial intelligence tools to generate your answers; copy, record, share or publish the questions, scenarios or prompts outside the Platform; and use bots, automation, scraping or reverse engineering on the Platform.
7.2. What we measure during the test. So that all candidates compete on equal terms, during the tests we record objective technical signals from your device: copy-and-paste attempts, tab switches or focus losses, time with the window hidden, exits from full-screen mode, number of connected screens, indications of automation or AI extensions, and typing patterns. You are notified before each test and must accept in order to start. These are device measurements, not AI inferences about you, and they are not used for any other purpose.
7.3. What those signals do NOT do. They do not reject anyone automatically. They are an indicative signal seen by the person who reviews your evaluation, alongside all the other information. The decision is always taken by a person.
7.4. Consequences. Where there are well-founded indications that a test was not taken under the conditions of clause 7.1, the result of that test may be declared invalid. In serious or repeated cases of fraud or impersonation, we may suspend or cancel your account under clause 14. Before invalidating a result or cancelling an account on this ground we will notify you in writing, with the specific reason, and you will be able to give your account of events.
7.5. So that your browser shows the camera-in-use indicator, in some tests the camera is switched on without recording or storing anything.
8. Video interview
8.1. Prior consent. The video interview is recorded (image and sound), transcribed and analysed using AI. It can only take place if you give your prior consent on the specific screen shown before recording. Recording and its AI analysis are an inseparable part of this test: there is no version without recording and no version without AI. If you do not give consent, you will not be able to take the video interview for that process.
8.2. You can withdraw it. You may withdraw your consent at any time by writing to dpo@joboapp.es.
8.3. What withdrawing does. Withdrawal stops future processing: it blocks new recordings and new analyses. On its own it does not delete what has already been recorded, which follows the deletion schedule in clause 9. If you also want it deleted ahead of schedule, ask expressly in the same email and we will do so.
8.4. Use of the video by companies. Companies that access your recorded interview are contractually bound to use it solely to evaluate your application within JOBO: they may not download it, redistribute it or keep it outside the process. Breach carries penalties of €500 to €5,000 per incident and termination of their contract with JOBO.
9. Retention and deletion of your data
9.1. We process your data in accordance with the Privacy Policy. In summary: your account and profile, while the account is active; the interview video, 7 days from the moment the company closes the process, and earlier if you delete your account; the transcript and the resulting evaluation are kept with the rest of your evaluation and are not deleted with the video; reusable test results, 90 days; the technical AI traceability log, 4 years and pseudonymised, without identifying you, as required by the European Artificial Intelligence Regulation.
9.2. Your rights. You can exercise access, rectification, erasure, restriction, objection and portability by writing to dpo@joboapp.es or from the Data Deletion page.
9.3. Response time. We will deal with your request within one month. If the request is particularly complex, we may extend it by up to two further months, informing you of the reason within the first month. We may keep certain data blocked for the legally required period where a legal obligation requires it or it is necessary to defend against claims.
10. Evaluation using artificial intelligence and your rights
10.1. How evaluation works. Evaluations are carried out wholly or partly by artificial intelligence systems. This system is classified as high risk under Regulation (EU) 2024/1689. AI outputs are tools supporting the company’s decision, and the company retains ultimate responsibility.
10.2. What your score is and is not. Your result is one element among otherswithin a human, comprehensive assessment of your application, not a judgement on your professional worth nor a prediction of your performance. The known limitations of the system are published in Automated Decisions.
10.3. Guaranteed human review. No decision affecting you is taken by AI alone. Before an evaluation has any effect on your application —including the company being able to see it— a person always reviews it. You do not need to request this: human intervention is part of the process by design.
10.4. Right to an explanation of the decision. If a decision taken on the basis of your evaluation affects you, you have the right to obtain a clear and meaningful explanation of the role the AI system played in it and of the main elements taken into account. The decision to hire or reject is taken by the company, which is the party that must give you that explanation; JOBO provides it with the necessary information and, if you come to us, we will help you channel your request.
10.5. If you disagree with your evaluation. You have the right to receive meaningful information about the logic applied, to express your point of view, to contest your evaluation and to ask for it to be reviewed again or deleted. You can do this from the “Ask for a human review” button in your dashboard, which opens a tracked request, or by writing to revision@joboapp.es. We will respond within a maximum of 30 days.
11. Services for candidates
11.1. Use of the Platform as a Candidate is free of charge. If we were to offer paid features in the future, their conditions, price and your right of withdrawal would be clearly explained to you before you contract them, and nothing you use free of charge today would become paid without your express acceptance.
11.2. We do not charge candidates for applying to a process, for taking tests or for receiving their evaluation.
12. Equality and non-discrimination
12.1. JOBO designs its tests and evaluation systems to assess job-related abilities and behaviours, and not to discriminate on grounds of sex, racial or ethnic origin, age, disability, sexual orientation or identity, religion or belief, political opinion, illness, language or any other personal or social condition.
12.2. We do not request or ask about special category data. If it appears spontaneously in an answer of yours, it is not used as a scoring criterion and you may ask for it to be deleted.
12.3. If you believe that a published job offer, a test question or your evaluation contains discriminatory content, you can report it to legal@joboapp.es. We will review the report, give you a reasoned reply and, where appropriate, remove the content or correct the evaluation.
13. Changes to these Terms
13.1. We may amend these Terms to adapt them to changes in the Service, in technology or in applicable law.
13.2. Notice period. We will notify you of any amendment at least 30 days before it takes effect, by email or through a prominent notice in your dashboard, stating what changes. Amendments are not retroactive: they do not affect processes or evaluations already completed before they take effect.
13.3. Exceptions to the notice period. The 30-day period does not apply in two defined cases: where the change must be applied immediately due to a legal requirement, and where it relates exclusively to a new feature that does not alter your existing conditions.
13.4. If you disagree. You may close your account before the changes take effect, at no cost or penalty. If you continue using the Platform after that date, we will understand that you accept the new version.
13.5. Each version is identified by a number and an effective date, shown in the header of this page. The full history is available to you at legal@joboapp.es.
14. Suspension, cancellation and inactivity
14.1. You may stop using the Service and request deletion of your account at any time, without giving reasons and at no cost.
14.2. We may temporarily suspend your access, or cancel your account, if you seriously breach these Terms: fraud or impersonation in the tests, providing false data, use for unlawful purposes, or conduct that harms other users or the Platform.
14.3. How we will do it. We will notify you of the suspension or cancellation in writing, with the specific reason and the facts it is based on, and you may submit representations at legal@joboapp.es. Unless there is a serious and immediate risk, suspension precedes cancellation. While your complaint is open we will preserve your file. If the cancellation turns out to be unjustified, we will restore your account and your evaluations.
14.4. Inactive accounts. If you do not access your account for 24 months, we will delete it. We will notify you by email 30 days beforehand, so you can prevent it simply by logging in.
15. Unlawful content and complaints about job offers
15.1. Job offers published on the Platform are the responsibility of the companies that publish them. JOBO is neither an employer nor a placement agency.
15.2. If you find an offer you consider unlawful, misleading, fraudulent or discriminatory, report it to legal@joboapp.es giving the link and the reason. We will acknowledge receipt, review the report and give you a reasoned decision. If we remove or restrict content, we will also inform whoever published it, with the reason and the available means of redress.
16. JOBO’s intellectual property
The Platform, its software, its design, the tests, the scenarios, the models, the prompts and the interface are the exclusive property of JOBO or its licensors. Any reproduction, transformation, distribution or unauthorised use is prohibited. In particular, and for the integrity reasons in clause 7, you may not copy, record, transcribe or distribute the content of the tests.
17. Liability
17.1. What we guarantee. We provide the Service with due diligence and are liable for its lack of conformity under the consumer legislation applicable to digital services. We work to keep the Platform available, but we cannot guarantee that it will operate uninterrupted and error-free at all times.
17.2. What we are not liable for. JOBO is not liable for: companies’ decisions about your application, which are theirs alone; the professional outcomes you obtain; the content of offers published by companies; or indirect damages, loss of profit or loss of opportunity arising from use of the Service.
17.3. What is never excluded. None of the above limits our liability for wilful misconduct, gross negligence, damage to life or physical integrity, or any other liability that the law does not permit to be excluded.
17.4. Your rights as a consumer. If you qualify as a consumer, all of the above is without prejudice to the rights granted to you by the mandatory consumer protection rules applicable to you, which cannot be limited by this contract.
18. Complaints
18.1. If something has not worked as you expected, write to hola@joboapp.es (support) or to legal@joboapp.es (contractual matters). We will give you an acknowledgement of receipt with a reference and will reply within a maximum of one month.
18.2. You may ask for the reply to be provided on a durable medium you can keep.
18.3. Before going to court, the parties will try to resolve the dispute through direct written negotiation, within a maximum of 30 days and at no cost to you. This attempt does not limit your right to go to the courts or to the consumer bodies available to you.
19. Language
19.1. These Terms are published in Spanish, English, French and Italian. Each language version is fully binding on the Candidate who contracts in that language.
19.2. The text is originally drafted in Spanish. If you find a discrepancy between versions, tell us at legal@joboapp.es: we will correct it and, in the meantime, the interpretation most favourable to you will prevail.
20. Final provisions
20.1. Partial invalidity. If any clause is declared void or unenforceable, the rest will remain valid, and the affected clause will be replaced by one that respects what was agreed within what is legally permissible.
20.2. Assignment. You may not assign your position or your account. JOBO may assign its position in the event of corporate restructuring or transfer of business, notifying you beforehand and without reducing your rights; if you disagree, you may close your account.
20.3. Notices. Communications will be sent to the email address linked to your account and to the addresses in clause 22.
20.4. Force majeure. Neither party will be liable for non-performance caused by events beyond its reasonable control, for as long as the event lasts and provided it is notified without delay.
20.5. Entire agreement and no waiver. These Terms and the documents in clause 1.2 constitute the entire agreement. Our not exercising a right at a given moment does not mean we waive it.
21. Governing law and jurisdiction
21.1. These Terms are governed by Spanish law.
21.2. If you are habitually resident in another EU Member State, you retain the protection afforded to you by the mandatory provisions of the law of your country of residence, which this clause cannot limit.
21.3. For any dispute, if you qualify as a consumer the courts of your domicile will have jurisdiction. Otherwise, those of Seville (Spain).
