2. Purpose and applicable legal documentation
This Legal Notice governs access to and use of the Platform. Using it entails acceptance of the provisions set out here.
This document informs; it does not replace the contracts. The conditions governing each relationship are:
- Terms of Service (candidates) — individuals using the Platform to take part in recruitment processes.
- Terms of Service (companies) — corporate clients.
- Privacy Policy and Privacy Policy for companies.
- Data Processing Agreement and list of sub-processors.
- Cookies Policy.
- Information on automated decisions and artificial intelligence.
- Accessibility statement.
- Security policy.
- Exercising your rights and data deletion.
3. Nature of the service
The Platform is a technology tool that allows companies to publish recruitment processes and assess applications, and allows candidates to take part in them.
JOBO does not decide who is hired, does not hire candidates, is not their employer and does not guarantee that a process will end in a hire or that an application will be selected. The selection decision rests exclusively with the company publishing the process, which also determines the requirements of the role and is responsible for the content of its job posting.
How the AI-assisted assessment systems work, their limits and the rights of the people assessed are described in Automated decisions and artificial intelligence.
4. Conditions of use
The user undertakes to make appropriate and lawful use of the Platform, in accordance with applicable law, good faith and public order.
The following is expressly prohibited:
- Publishing job postings that do not correspond to a real, available position, or whose content is false, misleading or discriminatory.
- Requiring candidates to make any payment in order to take part in a process, or requesting bank details, identity documents or money from them through the Platform.
- Impersonating an individual or a company, or presenting someone else’s application as one’s own.
- Uploading another person’s CV, documentation or data without their consent.
- Extracting, copying or reusing the Platform’s content or data on a mass or automated basis, including the use of robots, spiders or any unauthorised crawling technique.
- Introducing malicious code, attempting to access restricted areas or other people’s accounts, or compromising the security or availability of the Platform.
Breach of these conditions may result in the removal of the affected content or in the suspension or cancellation of the account, in accordance with section 6.
5. Content published by third parties
The Platform hosts content created and published by its users: the job descriptions and materials provided by companies, and the CVs, answers and recordings provided by candidates.
JOBO does not originate, select or modify that content and is not liable for it, on the terms set out in articles 13 to 17 of the LSSI-CE and articles 4 to 6 of Regulation (EU) 2022/2065. Once JOBO obtains actual knowledge that content is unlawful, it will act diligently to remove it or block access to it.
Anyone may report unlawful content through the channel in section 6.
6. Digital Services Act: contact and reporting of content
Pursuant to Regulation (EU) 2022/2065:
- Point of contact for authorities (art. 11). Member State authorities, the European Commission and the European Board for Digital Services may contact JOBO at legal@joboapp.es. Accepted languages: Spanish and English.
- Point of contact for users (art. 12). Any user may communicate with JOBO at legal@joboapp.es. Communications are handled by people, not solely by automated systems.
- Reporting unlawful content (art. 16). To report specific content, write to legal@joboapp.es stating: (a) why you consider the content unlawful, (b) the exact electronic address where it is located, (c) your name and email, unless the report concerns offences against sexual freedom or integrity, and (d) a statement that you believe in good faith that the information is accurate and complete. JOBO will acknowledge receipt, decide without undue delay and communicate its decision and the reasons for it to the reporting party.
- If your content is removed or restricted (art. 17). Anyone whose content is removed or whose account is restricted will receive a statement of reasons: what has been done and to which content, the grounds for the decision, whether an automated system was involved and how to challenge it. Nothing is removed silently.
- Supervisory authority. The authority designated as Digital Services Coordinator in Spain is the Comisión Nacional de los Mercados y la Competencia (CNMC).
JOBO qualifies as a micro enterprise for the purposes of article 19 of that Regulation.
7. Intellectual and industrial property
7.1. JOBO’s content. The software, design, texts, images, logos, distinctive signs, assessment models, questionnaires and the instructions given to the artificial intelligence systems are owned by JOBO PEOPLE TECHNOLOGIES, S.L. or by third parties who have authorised their use. Their reproduction, distribution, public communication or transformation without express authorisation is prohibited.
7.2. User content. Content provided by companies and candidates remains theirs. JOBO does not acquire ownership of it: it only obtains the licence of use, limited to providing the Service, set out in the applicable Terms of Service and Terms of Service for companies.
7.3. Text and data mining. JOBO reserves the rights of reproduction and extraction over the Platform’s content for text and data mining purposes, including the training of artificial intelligence systems, except to the extent that it expressly authorises them in the site’s robots.txt file, which constitutes the machine-readable expression of this reservation and of its exceptions. As at the date of this version, that file allows identified artificial intelligence crawlers to access public content, and excludes private areas and the job distribution feed. The reservation applies in full to any means of collection that is unidentified or that does not respect that file.
8. Prices
Prices for the services are published and kept up to date on the pricing page. Unless stated otherwise, prices addressed to companies are shown excluding VAT, which is added to the amount in accordance with the applicable rules in each case. Use of the basic features by candidates, including taking part in recruitment processes, is free of charge; any premium features are governed by the Terms of Service.
9. Codes of conduct
As at the date of this version, JOBO is not a party to any code of conduct within the meaning of article 10.1.g of the LSSI-CE. Should it adhere to one in the future, this section will state so together with how to consult it electronically.
10. Liability and availability
JOBO works to keep the Platform continuously available, but does not warrant the absence of interruptions, errors or delays in access, nor the permanent update of its content.
JOBO may modify, suspend, cancel or restrict access to the Platform or to any of its features on justified grounds and with reasonable prior notice, except where a technical or security emergency or a legal requirement arises, in which case it will inform users as soon as possible.
JOBO is not liable for damages arising from the user’s misuse of the Platform, nor for the selection decisions taken by companies.
All of the above is without prejudice to the mandatory rights granted to users who qualify as consumers under consumer protection law (Royal Legislative Decree 1/2007), which are neither limited nor excluded by this Legal Notice, and without prejudice to any liability that cannot lawfully be excluded.
11. Third-party links
The Platform may contain links to third-party websites. JOBO does not control those sites and is not responsible for their content, their data processing or their privacy policies. If you become aware that a linked site hosts unlawful content, please report it through the channel in section 6.
12. Governing law, jurisdiction and language
12.1. Governing law. This Legal Notice is governed by Spanish law.
12.2. Jurisdiction. Jurisdiction over disputes arising from the contractual relationship is determined in the corresponding clause of the Terms of Service or the Terms of Service for companies, whichever applies. Where the user qualifies as a consumer, the courts of their domicile shall have jurisdiction pursuant to article 90.2 of Royal Legislative Decree 1/2007, and this document may not alter that rule.
12.3. Language. The Spanish version of this Legal Notice is the official and prevailing one. The English, French and Italian versions are courtesy translations; in the event of any discrepancy, the Spanish text prevails.
12.4. Amendments. JOBO may update this Legal Notice. Each version is published with its number and its effective date. The version history is available on request at legal@joboapp.es.
